2. basis of contract
a) The following General Terms and Conditions regulate the contractual conditions between the Trio 21meter60 (seller) and the customer (consumer in the sense of § 13 BGB or entrepreneur in the sense of § 14 BGB) of the online shop: www.21meter60.de, insofar as individual provisions do not expressly apply only to consumers or only to entrepreneurs.
b) The General Terms and Conditions shall apply in the version valid at the time of conclusion of the contract for all contracts for the supply of goods and contracts for the provision of services concluded exclusively by means of distance communication. Deviating GTC of the customer shall only apply if their application has been expressly agreed.
c) The contractual language is German. The law of the Federal Republic of Germany shall apply. In relation to consumers, this choice of law shall only apply insofar as it does not violate mandatory provisions of the state in which the consumer has his habitual residence. Mandatorily applicable provisions of other states shall take precedence over German law. 3.
3. Offer, conclusion and storage of the contract
a) Information on our website represents non-binding offers to place an order. The purchase contract is concluded after receipt of the customer’s binding order by written confirmation of the contract by the seller, otherwise by sending the goods. The automatic confirmation of the receipt of the order does not constitute an acceptance of the contractual offer. If a purchase contract is not concluded within 2 weeks of receipt of the order, the purchase offer shall be deemed to have been rejected.9b
b) The following technical steps are required to place your binding order and to correct input errors before placing the order: Place the item in the shopping basket by clicking the button: “Add to shopping basket”. Before you press the button “Buy”, you will see a complete order overview and have the option to delete individual items. As soon as you click the button: “Proceed to checkout”, you will be taken directly to the order overview. Here you can again make changes to your shopping cart, as well as other corrections, e.g. in the billing or delivery address, payment methods. The ordering process is not completed until you press the button ‘order with obligation to pay’.
c) The data of your order and the text of the contract will not be stored by us in a form that you can access at a later date. Should you wish to document your order data, we recommend that you copy, print or otherwise save them before submitting the binding order.
4. Payment, delivery
a) Unless otherwise agreed, delivery of ordered goods shall be made exclusively against advance payment or via PayPal. In the case of payment in advance, payment must be made within 8 days of conclusion of the contract.
b) Delivery shall be made no later than 5 working days after receipt of payment, unless a delivery time deviating from this is expressly stated in the item description or a different delivery time has been expressly agreed.
c) The seller does not assume any procurement risk and reserves the right to withdraw from the contract in the event that the seller is not supplied or is not supplied on time. This shall only apply in the event that the Seller is not responsible for this and, in particular, that the Seller has previously concluded a congruent hedging transaction to fulfil the obligation under the contract. The seller shall inform the customer immediately of any lack of or delay in self-delivery and, if necessary, exercise the right of withdrawal. In the event of withdrawal, any services already received shall be returned without delay. 5.

6. Warranty, customer service, screen display
a) In the event of a material defect, the statutory claims for defects shall apply unless otherwise stipulated in b) and c).
b) For consumers, claims for defects become statute-barred after one year for the purchase of used goods. For entrepreneurs, warranty claims for new goods shall become statute-barred after one year, for used goods the warranty is excluded.
c) Excluded from the shortened period for the assertion of warranty claims are the claims for damages listed in § 309 No. 7 a and b BGB.
d) Any additional manufacturer’s warranties shall be governed by the warranty conditions specified by the manufacturer and printed in the product description. Any claims resulting therefrom must be asserted against the manufacturer. Statutory consumer rights arising from the warranty shall not be restricted by guarantee commitments.
e) Errors and misprints excepted.
All prices are quoted in Euro (€) without statutory value added tax. No sales tax is shown, since we are a small business according to § 19 UStG.
The respective packaging/shipping costs according to the item description and, in the case of cash on delivery, the cash on delivery charge are added to the product prices.

9. reservation of proprietary rights
The goods sold shall remain the property of Trio 21meter60 until payment has been made in full. The customer is not entitled to dispose of the goods by legal transaction until the acquisition of ownership. He undertakes to inform the seller immediately if third parties assert rights to the goods.
10. jurisdiction agreement
a) If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, it is agreed that the exclusive place of jurisdiction for all claims arising from or on the basis of this contract shall be our registered office: Burgunder Weg 4, 76835 Rhodt.
b) Clause 11 a) also applies to persons who do not have a general place of jurisdiction in Germany, or persons who have moved their place of residence or habitual abode outside Germany after conclusion of the contract, or whose place of residence or habitual abode is unknown at the time the action is brought.
11. Data protection
a) We collect, process and store your personal data exclusively to the extent necessary for the execution of the contracts and as permitted by law. Your data will not be passed on to third parties or used for other purposes unless you have consented or we are legally obliged to do so.
b) Only with your prior – separately declared – consent do we use your personal data for marketing measures, i.e. for sending customer information, newsletters and advertising from our company.
c) You can object to the processing and use of the data stored by us with your consent for purposes in accordance with b) at any time by sending a declaration to Trio 21meter60, to be addressed to: email@example.com.
We will then no longer use the data and delete it.
As a service provider, we are responsible for the content of our own shop. Links to external content (Internet pages of other providers) are dynamic references. We have checked the contents of such pages at the time of each initial linking to see whether they might give rise to any civil or criminal liability. A complete monitoring of the linked contents is not possible. However, if it is determined or if there are indications that a linked offer triggers civil or criminal responsibility, we will immediately remove the link to such a page.
